These Terms & Conditions govern the use of BER-CERTIFICATE.com. By using this website, submitting a request for BER quotations, registering as a BER assessor, submitting a quotation, selecting an assessor, paying a booking deposit or otherwise using the platform, you agree to these Terms & Conditions.
1. About BER-CERTIFICATE.com
BER-CERTIFICATE.com provides an online platform that helps property owners and other customers request and compare quotations from BER assessors.
BER-CERTIFICATE.com provides the platform through which customers and BER assessors can connect. BER-CERTIFICATE.com does not itself carry out BER assessments. The BER assessment service is provided independently by the BER assessor selected by the customer.
2. Customer Requests
Customers may submit property information through BER-CERTIFICATE.com in order to request quotations from BER assessors serving their area.
Customers are responsible for ensuring that the information supplied in a request is accurate and complete to the best of their knowledge.
Submitting a request does not guarantee that quotations will be received, that a particular assessor will submit a quotation or that an assessor will be available at a particular time.
3. Email Confirmation and Publication of Requests
A customer may be required to confirm their email address before a request is published or made available to eligible BER assessors.
Customers are responsible for providing a valid email address and completing any confirmation process required by the platform.
4. Customer Information and Privacy
BER-CERTIFICATE.com is designed to protect customer contact information during the quotation process.
Before a customer selects an assessor and completes the required booking process, assessors may only receive the information reasonably necessary to determine whether they wish to submit a quotation.
A customer’s full address, telephone number, email address or other restricted contact information will not normally be made available to an assessor before that assessor has been selected and the required booking deposit has been successfully paid.
5. BER Assessor Registration and Approval
BER assessors must register with BER-CERTIFICATE.com before accessing assessor-only features of the platform.
Registration does not automatically provide full access. BER-CERTIFICATE.com may review applications and require approval before an assessor is permitted to view eligible requests or submit quotations.
Assessors are responsible for ensuring that the information supplied during registration is accurate and up to date.
Assessors are also responsible for ensuring that they hold and maintain any registration, qualification, authorisation or other requirement necessary to provide the BER assessment services they offer.
BER-CERTIFICATE.com may suspend, restrict or remove assessor access where reasonably necessary, including where information supplied is inaccurate, platform rules are breached or there are reasonable concerns regarding misuse of the service.
6. Access to Customer Requests
Approved assessors may be shown customer requests that are eligible for them through the platform.
The availability of a particular request to an assessor may depend on factors such as the location of the property, the assessor’s service area and the status of the request.
BER-CERTIFICATE.com does not guarantee any assessor a particular number of requests, quotations, bookings or assignments.
7. Quotations
Approved BER assessors may submit quotations for eligible requests made available to them through BER-CERTIFICATE.com.
Quotations are provided by independent BER assessors. BER-CERTIFICATE.com does not determine the price quoted by individual assessors and does not guarantee that the lowest quotation will be the most appropriate quotation for a particular customer.
Where the platform permits it, an assessor may revise the amount of their quotation before the customer selects that assessor and the job is assigned.
Assessors are responsible for ensuring that quotations they submit accurately represent the price and service they intend to offer.
8. Choosing a BER Assessor
The customer is responsible for deciding which quotation and BER assessor to select.
Customers should consider the information available to them and satisfy themselves that the selected assessor and quotation are suitable for their requirements.
BER-CERTIFICATE.com does not select an assessor on behalf of the customer unless a specific feature of the website expressly states otherwise.
9. Booking Deposit and Assignment
After selecting a quotation, the customer may be required to pay a booking deposit through BER-CERTIFICATE.com in order to confirm the booking and assignment of the selected BER assessor.
The amount of the booking deposit will be displayed to the customer before payment is completed.
Once the required booking deposit has been successfully paid, the selected BER assessor will normally be assigned to the request.
Following assignment, the request may be marked as no longer available and other assessors may no longer be able to submit quotations for that request.
10. Non-Refundable Booking Deposit
The booking deposit payable through BER-CERTIFICATE.com is non-refundable once payment has been successfully completed, except where a refund is required by applicable law.
By proceeding with payment, the customer acknowledges and agrees that the booking deposit is non-refundable and that payment is used to confirm the customer’s selection of the chosen BER assessor and assign the request to that assessor.
Once the booking deposit has been paid and the assessor has been assigned, the request may be closed to further quotations and the selected assessor may receive the customer information necessary to arrange the BER assessment.
If the customer subsequently changes their mind, decides not to proceed with the assessment, fails to provide reasonable access to the property or otherwise cancels the booking after the booking deposit has been paid, the booking deposit will not normally be refunded.
If the selected BER assessor is unable or unwilling to carry out the assessment, the customer should contact BER-CERTIFICATE.com as soon as possible. The circumstances will be reviewed and, where appropriate or required by applicable law, a refund or another suitable resolution may be provided.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory right or refund entitlement that cannot lawfully be excluded under applicable Irish or European Union consumer law.
11. Release of Contact Details
Once a customer has selected an assessor and successfully completed the required booking deposit payment, relevant contact and property information may be made available to the selected assessor.
The customer may also receive contact information for the selected assessor so that the parties can communicate directly and arrange the assessment.
Contact information obtained through BER-CERTIFICATE.com must only be used for legitimate purposes connected with the relevant BER assessment and must not be used for unrelated marketing, unsolicited communications or other unauthorised purposes.
12. Arranging the BER Assessment
Following assignment, the customer and selected BER assessor are responsible for arranging a suitable date and time for the property assessment and for communicating regarding access and any documents or information required.
Questions relating specifically to an assessment appointment, property inspection, assessment methodology or BER certificate should normally be discussed directly with the selected BER assessor.
13. Independent BER Assessors
BER assessors using BER-CERTIFICATE.com operate independently.
They are not employees of BER-CERTIFICATE.com merely because they register with, receive requests through or submit quotations using the platform.
The selected assessor is responsible for carrying out the assessment and providing their professional service to the customer.
BER-CERTIFICATE.com provides the marketplace and communication infrastructure that helps customers and assessors connect but does not itself perform the BER assessment.
14. Customer Responsibilities
Customers are responsible for providing accurate property and contact information and for communicating honestly with assessors.
Where an assessment has been arranged, the customer is responsible for providing reasonable access to the property at the agreed time and for supplying documents or information reasonably required by the assessor.
Customers must not use BER-CERTIFICATE.com to submit fraudulent, misleading, unlawful or deliberately false requests.
15. BER Assessor Responsibilities
BER assessors are responsible for providing their services professionally and complying with the legal, regulatory and professional requirements applicable to their work.
Assessors are responsible for the accuracy of the information contained in their profile and quotations.
Assessors must treat customer information confidentially and must not misuse personal or property information obtained through BER-CERTIFICATE.com.
16. Payments Between Customer and Assessor
Unless expressly stated otherwise during the booking process, any amount payable directly to the BER assessor for the assessment service is a matter between the customer and the selected assessor.
Customers should ensure that they understand the assessor’s quoted price and any payment arrangements before the assessment is carried out.
17. Reviews
BER-CERTIFICATE.com may allow customers to submit reviews about their experience with a BER assessor.
Reviews should reflect a genuine customer experience and must not contain knowingly false, unlawful, abusive, threatening, defamatory or otherwise inappropriate material.
BER-CERTIFICATE.com may moderate, refuse to publish, restrict or remove reviews where there are reasonable grounds to believe that a review breaches these Terms, is fraudulent or is otherwise inappropriate for publication.
18. Acceptable Use of the Website
Users must not misuse BER-CERTIFICATE.com or attempt to interfere with its normal operation.
Users must not attempt unauthorised access to accounts or systems, introduce malicious software, impersonate another person, submit deliberately misleading information, scrape restricted personal information or use the platform for unlawful purposes.
BER-CERTIFICATE.com may restrict or suspend access where reasonably necessary to protect customers, assessors, the website or other users.
19. Website Availability
We aim to keep BER-CERTIFICATE.com available and operating correctly. However, uninterrupted or error-free access cannot be guaranteed.
The website or individual features may occasionally be unavailable due to maintenance, upgrades, technical problems, security requirements or circumstances outside our reasonable control.
Features of the website may be changed, improved, replaced or withdrawn where reasonably necessary.
20. Third-Party Services
BER-CERTIFICATE.com may use third-party service providers for functions such as website hosting, payment processing, email delivery, mapping, security, analytics or other technical services.
Where users interact directly with a third-party service, additional terms or privacy provisions of that provider may apply.
21. Liability
Nothing in these Terms & Conditions excludes or limits any liability where doing so would be prohibited by applicable law.
Subject to applicable law, BER-CERTIFICATE.com is not responsible for the professional acts or omissions of independent BER assessors or for the technical outcome, accuracy or contents of a BER assessment carried out by an assessor.
BER-CERTIFICATE.com is not responsible for disagreements arising solely between a customer and an independent assessor concerning matters outside the reasonable control of the platform.
Users remain responsible for making their own decisions when selecting an assessor and entering into arrangements for BER assessment services.
22. Personal Data and Privacy
Personal information collected through BER-CERTIFICATE.com is handled in accordance with our Privacy Policy and applicable data protection requirements.
Users are responsible for keeping their login details secure and should not knowingly allow another person to use their account without authorisation.
23. Intellectual Property
Unless otherwise stated, the website content, branding, layout and original materials published by BER-CERTIFICATE.com are protected by applicable intellectual property rights.
Users may use the website for its intended purpose but may not reproduce, commercially exploit or redistribute protected website content without permission where such permission is legally required.
24. Changes to These Terms
These Terms & Conditions may be updated from time to time to reflect changes to BER-CERTIFICATE.com, its services, payment arrangements, business operations or applicable requirements.
The current version published on BER-CERTIFICATE.com will apply from its stated effective date.
25. Governing Law
These Terms & Conditions are intended to be governed by the laws of Ireland.
Nothing in these Terms is intended to restrict any mandatory consumer rights or other legal protections that apply to a user.
